Elon Musk has announced his intention to appeal the California federal court’s dismissal of his lawsuit against OpenAI and its CEO, Sam Altman. The legal battle centers on Musk’s accusations of breach of contract and unjust enrichment, stemming from OpenAI’s transition from a non-profit research lab into a capped-for-profit enterprise.

“I am going to file an appeal before the American courts, as creating a precedent for stealing charitable organizations is extremely detrimental to philanthropy in the United States,” Musk stated.

Musk emphasized that the judge and the nine-member jury never ruled on the actual merits of the lawsuit, but instead focused on a “technical issue related to the timeline.” He reiterated his stance on the founders’ financial gains, stating, “It is undeniable that Altman and Brockman enriched themselves at the expense of a charitable organization. The only unknown is when they did it!”
